This Coaching Agreement (the “Agreement”) is entered into this Today (the “Effective Date”), between Unstoppable 365 LLC Coaching and Client (here within “Customer/Client”), and SC Coaching (“Service Provider”). The Customer/Client and Service Provider are sometimes individually referred to herein as a “Party” and collectively as the “Parties.”

WHEREAS, the customer/client has requested that the Service Provider furnish the Service of Unstoppable 365 LLC Coaching Program for $297 Per month for a minimum of 6 months then month to month after to the Customer/Client, and Service Provider has agreed to provide the services set forth in this Agreement.

SET FORTH, in the consideration of the undertakings of this agreement and both Parties herein, and other good and valuable considerations, the receipt and sufficiency of this agreement, which is hereby acknowledged, and intended as legally bound, both Parties agree to the following:

1. Unstoppable 365 LLC Coaching Services: Subject to the terms and conditions of this Agreement, the Service Provider hereby agrees to provide to Customer/Client the Sean Crane Coaching Program for $297 Per month for a minimum of 6 months then month to month after set forth by the terms and conditions of this agreement.

2. Unstoppable 365 LLC Coaching Monthly Payments: All Coaching Fees Monthly Plans and the monthly fees are based on the Unstoppable 365 LLC Coaching Program for $297 Per month for a minimum of 6 months then month to month after.

Pay in Full for 6 Months for $1485

Pay in Full for 12 Months for $2997

FULFILLMENT POLICIES

Refund Policy: At Unstoppable 365, all sales of products and services are final. We do not offer refunds for any purchases, including training sessions, digital downloads, or other services. If you believe there has been an error in billing, or if you experience issues with any product or service, please contact our support team at [email protected]. We will review each case on an individual basis to determine if a credit or remedy is warranted.

Shipping or Delivery Policy: Unstoppable 365 primarily offers digital services and does not generally involve shipping or delivery of physical products. Any downloadable materials or digital products will be available for download upon the completion of your purchase. For any physical products offered in the future, shipping fees, if applicable, and delivery timeframes will be communicated clearly at checkout. If there are any issues with digital access or physical product shipping, please contact us at [email protected].

Return Policy and Process: As we do not offer physical products for sale, we do not currently have a return process. All sales of digital products and services, including personal training sessions, downloads, and materials, are final and non-refundable. In the event you encounter any technical difficulties accessing a purchased product or service, please reach out to our customer support team for assistance at [email protected].

Cancellation Policy: You may cancel the use of our services at any time. However, cancellations will not result in refunds for any unused portion of the services or products purchased. If you need to cancel or reschedule any personal training session, please provide at least 24 hours notice by contacting [email protected] to avoid being charged for the session. Unstoppable 365 reserves the right to cancel or modify services at any time, and any paid unused portion may be credited back at the company's discretion.

COACH CLIENT STANDARDS

Today I am choosing to enroll in the Unstoppable 365 LLC Coaching Program and understand that I am paying based on the above payment and fees section of this agreement today and if I have chosen Payments, I understand that I am making payments based on the agree upon structure above in the Payment for the Unstoppable 365 LLC Coaching Program. I understand that there are no refunds and that this coaching program is non-transferable, and that this agreement is binding on the date signed and that I am responsible for all payments per this agreement.

I understand all the coaching services and tools will be provided to me do create success only if I use the tools, coaching and guidance

I understand that I receive access to the Coaching App and that all my coaching program deliverables (i.e., habit and mindset, nutrition, fitness, communication, etc.) will be delivered through the app. I understand that I receive Group Coaching Sessions, that my coaching provides various forms of feedback to me each week, I will have updated nutrition, fitness, and mindset coaching each week, and that I will have access to my coach via the app in the Coaching Chat Group. I also understand that I will have access to a Private Facebook Community as well.

I authorize Unstoppable 365 LLC Coaching the owning Company of the Unstoppable 365 LLC Coaching Program to charge my Credit/Debit Card or bank account for my Coaching Program per this Agreement. I agree that for Unstoppable 365 LLC Coaching to service and collect funds I may be contacted via text, email, and phone personally, which could result in charges to me. I understand if my payment fails due to insufficient funds or credit card failure that I must pay all back dues plus a $20 insufficient funds/failed payment penalty for each occurrence. I understand I will have no access to coaching until payments are satisfied.

I understand that for any coaching program to work I must be open and honest with my coach, that I must communicate with my coach, and that I must be willing to be coached in all areas that will create success that include but are not limited to Mindset, Habits, Nutrition, Fitness, and accountability. I understand that ultimately all results are dependent on the work, effort, and consistency I put into my coaching program.

RELEASE OF LIABILITY AND ASSUMPTION OF RISK

I understand that participating in the Unstoppable 365 LLC Coaching Program through Unstoppable 365 LLC Coaching, that I am responsible for all my activities and nutritional consumption, and that with any program there may be risks involved. I understand that all my coaching is recommendations and I can choose to follow them and/or participate. By participating and/or following any recommendations that Unstoppable 365 LLC Coaching takes no responsibility for the outcome of any program whether you or someone else causes it. Specific risks vary from one activity to another, and the risks range from minor injuries to major injuries, such as catastrophic injuries including death. In consideration for your acceptance of the benefits under this agreement, I understand and voluntarily accept this risk and agree that Unstoppable 365 LLC Coaching, its officers, directors, employees, volunteers, agents, and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss or any damage to you, your spouse, guests, unborn child, or relatives resulting from the negligence of Unstoppable 365 LLC Coaching, or anyone on Unstoppable 365 LLC Coaching behalf or anyone else whether related to exercise or not.

I, the undersigned participant, understand that I am enrolling in a coaching program that may offer physical activity including but not limited to walking, MMA workouts, Cross Training, Weightlifting, General Sports Drills, Plyometric Movements, Aerobic Training, Contact Sport Training. I have been strongly encouraged to consult with my doctor prior to starting an exercise program or increasing the intensity of an existing program both in this document and by Unstoppable 365 LLC Coaching. I assume this responsibility as indicated by my below signature and if I chose to, will act on this advice prior to the implementation of a recommendation made by Unstoppable 365 LLC. I hereby affirm that, to the best of my knowledge, I do not suffer from any condition that would prevent or limit my participation in this or any Fitness or Coaching Program offered by Unstoppable 365 LLC Coaching and have not withheld any related information from Unstoppable 365 LLC Coaching.

I have been determined to be other than apparently healthy, I have been given a physician's release, as required by Unstoppable 365 LLC Coaching. I am taking no medications that may adversely affect my fitness activities, and this release, with or without physician's restrictions, has been given to Unstoppable 365 LLC Coaching. In addition, I acknowledge that if my health changes, it is my responsibility to recognize the change and seek medical advice to help me decide so that my coach can alter aspects of my coaching program to fit within my physician’s recommendations.

I fully understand that I may injure myself as a result of my participation in Unstoppable 365 LLC Coaching’s Unstoppable 365 LLC Coaching Program and I hereby release Unstoppable 365 LLC Coaching its board, employees and agents, from any liability now or in the future for any injury, including but not limited to heart attacks, death , muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries and any other illness, soreness or injury however caused, occurring during, or after my participation in the Fitness Program offered unless caused by the trainer's recklessness or intentional misconduct.

In consideration of my participation in Unstoppable 365 LLC Coaching’s Unstoppable 365 LLC Coaching Program, I, for myself, my personal representatives, administrators, heirs, and assigns, hereby holds harmless Unstoppable 365 LLC Coaching, its Board, employees, and agents, from any claims, demands, and causes of action, including reasonable legal expenses and attorney's fees, arising from my participation in the Fitness Program unless caused by the trainer's recklessness or intentional misconduct. I hereby affirm that I have read, have been honest with Unstoppable 365 LLC Coaching, and fully understand the above information; I have been given the opportunity to present questions in all related matters, and am willing to participate.

You agree to indemnify, defend, and hold Unstoppable 365 LLC Coaching harmless against any liability caused by your negligence or other wrongful acts or omissions. You further agree to hold harmless, defend and indemnify Unstoppable 365 LLC Coaching from all lability, damages, defense costs, including attorneys’ fees, or from any other costs incurred in connection with claims for bodily injury, wrongful death or property damage brought by you, your guests, or minors, even if Unstoppable 365 LLC Coaching was negligent. Further, you understand and acknowledge that Unstoppable 365 LLC Coaching does not manufacture fitness or other equipment at its facilities but purchased or leases equipment. You understand and acknowledge that Unstoppable 365 LLC Coaching is providing recreational health and fitness services and may not be held liable for defective products. I fully understand all aspects of my agreement and commitment.
